Is it legal for the ACC to not allow solar panels? We looked into getting some a few years ago and decided not to because of the expense. However, from what I understand an HOA cannot get in a property owner’s way of installing them.

The ACC and the HOA board are responsible for evaluating and upholding the rules that govern our community. These rules apply to everyone and are intended to protect the integrity and value of everyone. It is flawed to believe that regardless of what the rules are an owner can do as they please. We run our community in what I believe is a fair and respectful way. I ask and trust the members of our ACC to evaluate homeowner requests against the rules we have set in place. Any decision made by the ACC can be appealed to the board for review, the groups operate separately for exactly that reason.
Additionally things change over time and items that may not have been desired 10 years ago may be more common now. If there is a need to amend the HOA rules this can also be done but there is a process that must be followed.

At the time we looked at doing it, solar panels were outside of an HOA’s jurisdiction… regardless of what the HOA rules are a property owner could install them If they wanted to.
